A judge in New York has rejected Prince Andrew's attempt to persuade a US court to throw out a sexual abuse lawsuit brought against him by longtime American accuser Virginia Giuffre.

andrew is being sued by ms giuffre, formerly virginia roberts, who claims he "committed sexual assault and battery" upon her when she was a teenager and intentionally caused her emotional distress while the late financier jeffrey epstein was trafficking her.

kaplan said it was too early to assess andrew's efforts to cast doubt on the truth of ms giuffre ’ s allegations, even though his efforts would be permissible at trial."

The duke denies all the allegations against him.

it means the duke of york will face a civil sex case trial later this year.

Discovery The duke has now failed in his attempt to get this civil case thrown out, and therefore the legal process of 'discovery' continues.

Discovery is also likely to include depositions.

Option one : Give evidence Firstly, he could decide to answer questions from Mr Boies in a deposition and share personal documents with Ms Giuffre's legal team.

Judge Lewis Kaplan had suggested a jury trial could start in September 2022.

The judge would then make a ruling on his liability and set damages.

To stem further damage to the Royal Family, the duke may decide to settle.

Giuffre, who has also alleged that Epstein and Maxwell sexually abused her, said they had coerced her into having sex with Andrew in London.

The judge also rejected Andrew's claims that Giuffre ’ s civil allegations against him lack necessary specificity.

Since Giuffre had already received $ 500,000 in a legal settlement with Epstein, any settlement could run into the millions of dollars ( some reports have put it as high as $ 5m ).

The 2009 document said Ms Giuffre had agreed to "release, acquit, satisfy, and forever discharge" Epstein and "any other person or entity who could have been included as a potential defendant".

He continued : "In a similar vein and for similar reasons, it is not open to the court now to decide, as a matter of fact, just what the parties to the release in the 2009 settlement agreement signed by Ms Giuffre and Jeffrey Epstein actually meant.

"ms giuffre's complaint is neither 'unintelligible ’ nor ‘ vague ’ nor ‘ ambiguous. ’ it alleges discrete incidents of sexual abuse in particular circumstances at three identifiable locations.

It identifies to whom it attributes that sexual abuse."

US judge Lewis Kaplan refused to dismiss the case after hearing arguments from lawyers representing the royal and his accuser Virginia Giuffre.

"It is only one step in the process, it does not resolve the case but it rejects certain legal defences Prince Andrew was putting up to avoid the trial," he said.

He has just lost his latest legal battle after Manhattan federal court judge Lewis Kaplan ’ s ruling today that the sexual abuse lawsuit against him should proceed to trial, despite his lawyers advancing a variety of technical arguments, including that Virginia Giuffre no longer lives in the US, that she agreed in a 2009 deal not to pursue claims against certain other people, and that the court summons had not been properly served.

One possibility left to him is settling with Giuffre out of court.

speaking to sky news this evening, ms giuffre's lawyer david boies said andrew would not be a "pleased with the court's decision" as referred to in the settlement, as the 2009 lawsuit made no allegation that the duke had trafficked individuals for illegal sexual activity.

The duke's lawyer told Judge Kaplan that Ms Giuffre's lawsuit "should absolutely be dismissed", arguing it was "unfair" and "unjust".

The ruling comes after Ghislaine Maxwell was last month found guilty of recruiting underage girls to be sexually abused by her ex-boyfriend Epstein, who killed himself in 2019 while awaiting trial on sex-trafficking charges.
